The first thing you should do is speak to an experienced personal injury lawyer. This is because there are many traps and pitfalls lying in store for injured people who deal directly with an opposing insurance company whether you were injured due to a car accident, medical malpractice, a defective product or in a workplace injury. Among other things to avoid are giving statements to the other party’s insurer and signing an authorization letting them get your medical records or even to communicate with your doctor! (A possible exception to this is in workers compensation cases, where you must cooperate with reporting requirements and your medical care is being directly paid for by your employer’s insurer.) Even if you don’t intend to hire a lawyer, at least get their (usually free) advice about what to do, and more importantly what not to do, before you deal with the other party or their insurer.
